Tanzania’s Luhaga Mpina Challenges Parliamentary Suspension in High-Stakes Legal Battle

Dar es Salaam, July 30, 2024 – Luhaga Mpina, the embattled Member of Parliament for Kisesa, has launched a high-profile legal battle against his recent suspension from parliamentary sessions.
Mpina’s legal team has filed three constitutional cases in the High Court’s Small Claims Division in Dar es Salaam, challenging the suspension that bars him from attending 15 parliamentary sessions. The cases are directed at the Speaker of the National Assembly, Dr. Tulia Ackson, and the Attorney General, Dr. Eliezer Feleshi.
The legal team argues that the suspension contravenes parliamentary rules and regulations. Edson Kilatu, one of the prominent lawyers representing Mpina, revealed that the team, which includes around 100 lawyers, has also initiated cases against eight individuals, including key ministers and officials.
One of the cases challenges alleged illegal sugar importation, targeting Agriculture Minister Hussein Bashe, Finance Minister Dr. Mwigulu Nchemba, and TRA Commissioner Yusuph Mwenda, among others. Another case involves 24 sugarcane farmers from the Kilombero Valley, who are contesting amendments to the 2024 Finance Act, claiming these changes undermine the Sugar Board’s authority to regulate sugar imports.
Kilatu stressed, “This is not just Mpina’s fight; it’s about upholding the Constitution for every Tanzanian. We are committed to ensuring justice is served.” He added that the legal team is prepared to navigate through all necessary legal procedures to support the cases.
Dr. Rugemeleza Nshala, the lead attorney, highlighted the significance of the cases, noting the involvement of over 100 lawyers. “This issue transcends individual concerns. It’s a matter of constitutional adherence and governance that affects all Tanzanians,” Nshala said. He also welcomed additional support from the public to ensure the cases proceed effectively.
Mpina, reflecting on his situation, remains resolute despite his parliamentary suspension. “This case is unprecedented in Tanzanian history and underscores our commitment to transparency, accountability, and democratic principles,” he asserted. “Although I am barred from parliamentary sessions, my determination to advance these principles is unwavering.”
Before the suspension decision, Speaker Dr. Tulia Ackson had instructed Mpina to provide evidence in parliament regarding allegations against Agriculture Minister Bashe over sugar importation.
After presenting the evidence, Mpina faced charges of contempt for allegedly undermining the Speaker and parliamentary proceedings by submitting unprocessed evidence. The parliamentary ethics committee recommended his suspension, which was approved by parliament on June 24, 2024.
